Terms and conditions

1. TERMS OF THE CONTRACT

These terms and conditions of sale are to govern the sale by us, Doors and Fittings Ltd, and the purchase by you, the Buyer of Made to measure Kitchen and Bedroom doors, accessories and fittings in accordance with any contract between you and us and shall prevail over any terms put forward by you, unless we expressly agree to them in writing. Otherwise nothing that we do or that any employee, representative or agent of ours does, shall mean that we have accepted any terms put forward by you. By accepting delivery, you affirm that you agree to be bound by these terms.

2. REQUEST FOR DOORS AND FITTINGS

 

2.1 Buyers may order Doors and accessories via our automated pricing on our website or in writing by email, text or post to the addresses and numbers clearly listed throughout the website.

2.2 Any tender or quotation which we provide to you in writing will be valid for a maximum of 30 days, unless we confirm otherwise in writing. Automated website quotations will automatically expire on leaving the website.

2.3 If we provide you with a tender or quotation for Products, this is an invitation to place an order. There will be no contract between us until we confirm our acceptance of any order in writing.

2.4 All orders placed with Doors and Fittings Ltd outside of the Website must be in writing with all dimensions clearly set out and specified on an outline drawing of the products required.

 

3. SUPPLY OF DOORS

 

3.1 We will supply the Doors in the quantities stated on the order to the specifications set out on the Website or outline drawing/list of the Doors supplied by you through any means outlined in 2.1 and ( subject to clause 4.1 ) during the week for delivery which we notify to you.

3.2. All manufacturing is carried out to normal wood working tolerances .

3.3. If we are unable to supply Doors and Accessories within a reasonable time after any date fixed for delivery we may, at our discretion, cancel your order and return any money already paid by you, but without interest, compensation or any other payments whatsoever.

 

4. DELIVERY

4.1 Any date or time that we give for the delivery of Doors and Accessories is given in good faith but is an estimate only. All such times and dates are approximate only and we shall not be deemed to be in breach of terms or liable in any manner for any direct or indirect costs as a result of changing delivery dates. Time shall not be of the essence of these terms.

4.2 The Doors and Accessories shall be deemed to have been delivered by us delivering them to the address specified in your order and at the moment that you start to unload the consignment from the delivery vehicle. We shall not be required to deliver parts of an order to more than one address unless previously agreed in writing by us.

4.3 We shall not be liable for any loss or damage suffered by you as a result of any delay in delivery or failure to deliver the Products to you.

4.4 The price quoted for Doors and Fittings ordered includes delivery to the delivery address stated on your order. If you request us to deliver to another address, we shall make an additional charge for delivery which will be based on any extra cost to us in so doing and which will be notified to you prior to the revised delivery address being accepted by us.

4.5 If the premises or property we have been requested to deliver to is closed when we attempt delivery or there is no answer or if delivery is refused, delivery will be made as soon after as is practical and we shall be entitled to make an additional delivery charge to you based on any extra cost to us.

4.6 You will provide the necessary assistance to safely unload and store Products delivered to you. You will make sure that the delivery vehicle is unloaded within a reasonable time.

4.7 You will ensure that a sufficiently accessible and dry ground floor area is available upon delivery ( i.e. hallway, garage etc ) where the Product may be stored checked off and inspected by you.

 

5. RETURNS POLICY

Due to the bespoke nature of our Made to measure Doors and Accessories business we are unable to accept returns for credit. Some standard materials and accessories however may be returned at your cost and may be subject to a restocking charge provided the item/s is unused and as supplied. We must be informed in writing before any items can be authorized for return.

Goods that are ordered incorrectly or that are no longer required.
Doors and Fittings must be informed of all relevant details such as order number, and agree to any return.
Goods must be returned within 14 days of the delivery date.
A 20% restocking charge will apply.
Manufactured items cannot be returned.
Goods must be returned in their original packaging and be fit for re-sale. They must not be damaged and packaging must not be defaced.
The customer is responsible for any return costs, such as shipping and packaging.
Due to logistical complexities we will be unable to return goods on our own vehicles.
Other Returns.
Goods must be checked and any issues must be reported within 24 hours.

Photographic evidence may be required.
In certain situations, i.e. due to Door and Fittings error, we will collect & return the goods.
Items must be replaced in order for them to be returned with no restock charge.
Goods that we are unable to return to stock will not be credited.

6. CANCELLATION OF/OR CHANGES TO ORDERS

All cancellations and alterations to confirmed orders must be made in writing (email, fax or letter) Telephone calls can be made initially for expediency.

6.1 An order may be cancelled within 24hours of confirmation. A full refund will be made within 5 Days.

6.2 An existing order may be altered within 24 hours of confirmation and you will be informed of any alteration in the final price.

6.3 You may not cancel or alter an order after the cancellation period has expired unless we confirm in writing that we are able to accept the cancellation or alteration. If we do accept a cancellation, we have the right to charge you a cancellation fee of up to 100% of the value of the order depending of the amount of bespoke work we have done on the order.

7. DAMAGE, SHORTAGE AND LOSS

7.1 Any claim by you relating to Products damaged on delivery or non-delivery or shortage must be made in writing to us within 5 days of the delivery including photographic evidence. Obvious damage should be noted on the delivery note at the time of delivery and where possible, left on the delivery vehicle.

7.2 Within 7 days of receiving a claim by you in respect of Products damaged on delivery or non-delivery or shortage, we will replace ( in respect of damage ) or deliver ( in respect of non-delivery or shortage ) the products free of charge only if:-

7.2.1 We are notified within 5 days of the delivery

7.2.2 We collect or inspect the Products, from or at the delivery address and are satisfied that the damage occurred prior to delivery to you.

And 7.2.3 Provided the damaged or incorrect products has not been worked upon, cut or fitted without agreement from the company.

8. PRICE AND PAYMENT

8.1 The price for Doors and Fittings will be as shown on our website

8.1.1 Made to measure prices will be automatically calculated on the website, based on the dimensions submitted by you and will be clearly detailed in the shopping cart ( including delivery ) prior to placing order.

8.1.2 All other associated products will clearly show prices.

8.1.3. Delivery charges will be automatically updated.

8.2 We do not offer any settlement discounts.

8.3 Unless stated otherwise, all prices , where applicable, are fully inclusive of value added tax at the prevailing rate.

8.4 Payment is not considered received from you until we have notification of cleared funds representing the amount paid in our bank account or the bank account of our agent or nominee.

8.5 All payments must be in pounds sterling.

8.6 Payments may be made through HSBC’s secure website with all major credit and debit cards. Cheque payments are also accepted and full details are available at the point of choosing payment method.

9. WARRANTY

All “A Unique Choice” products listed in our brochures, available through the website are covered by a 6 YEAR Guarantee.

10. INTELLECTUAL PROPERTY RIGHTS / CONFIDENTIALITY

The Doors, related products or parts of them, are or may be protected by patent, copyright and design rights. Any rights relating to confidential information and other intellectual property rights in relation to the products remain with their legal owner solely and absolutely.

11. RISK AND TITLE

11.1 All Products supplied by us are at your risk from the moment of delivery under clause 4.2 and you should insure them against loss or damage.

11.2 Title of the product remains the property of Doors and Fittings ltd until paid for in full.

12. LIABILITY

12.1 We will not accept any claim:-

12.2.1 resulting from the ingress of moisture at any unfinished edges cut by customers.

12.2.2 in relation to fair wear and tear.

12.2.3 for damage caused by negligence in unwrapping and handling of Doors and accessories, or any third party handling, working or standing on products.

12.2.5. resulting from the failure of the website, it’s operation or that of any linked or connected sites including any service providers faults and failures in their networks and equipment.

12.3. We shall not be liable to you and there shall be no breach of contract in relation to the supply of Products to you, if we delay or fail to perform our obligations under these terms and conditions due to a cause beyond our reasonable control.

12.4. Our liability is limited to the replacement of any faulty Products or to a maximum liability of not more than the price of such Doors or related products.

13. INDEMNITY

13.1 You will indemnify us against any damages, losses, costs, claims or expenses incurred by us in respect of any loss we suffer directly or any claim brought against us by any third party for:-

13.1.1 Any loss, injury or damage wholly or partly caused by the products or their use;

13.1.2 Any loss, injury or damage in any way connected with the performance of this contract;

13.1.3 Any loss or damage caused by you during unloading of the Products in accordance with clause 4.6;

14. ASSIGNMENT

We may allow another person to take over our rights under these terms. If we do so, that person will take over and be responsible for all our rights and responsibilities to you. You may not pass on your rights and responsibilities to anyone else.

15. RELAXING THE TERMS OF THE AGREEMENT

Even if we temporarily relax any of these terms, we may at any time decide to enforce the terms strictly again.

16. GOVERNING LAW AND JURISDICTION

These terms are governed by English law and any dispute shall be within the jurisdiction of the courts of England and Wales.
